§ 1 Scope
These General Terms and Conditions ("Terms") apply to all online orders and table reservations made through the website alpizena.at. Deviating terms proposed by the customer are not recognized unless we expressly agree to them in writing.
§ 2 Formation of Contract
The presentation of dishes and beverages on our website does not constitute a legally binding offer. By completing the ordering process and confirming payment, the customer submits a binding order. The contract is formed upon our order confirmation (by email or on the website).
§ 3 Prices and Payment
All prices are final prices including statutory Austrian VAT. We do not serve alcoholic beverages. Payment is made via the offered payment methods (credit card via Global Payments, PayPal). The charge is made at the time of ordering.
§ 4 Right of Withdrawal
Pursuant to § 18(1) no. 10 of the Austrian Distance and Off-Premises Contracts Act (FAGG), there is no right of withdrawal for contracts for the delivery of food that may spoil quickly or whose expiry date would soon be exceeded. Orders placed are therefore binding.
§ 5 Delivery
Deliveries are made only within the stated delivery area in Vienna. The delivery times stated are estimates and not binding. In the event of force majeure or unforeseen circumstances, we reserve the right to delay delivery.
§ 6 Table Reservations
Table reservations made through our website are binding requests. We confirm the reservation by email. If no confirmation is sent, no reservation has been made.
Cancellation by the customer: Free cancellation is possible up to 24 hours before the reserved time. After that, we reserve the right to charge a no-show fee of €10 per person (only for groups of 4 or more with prior telephone registration).
Cancellation by the restaurant: In the event that we need to cancel (e.g. due to overbooking or operational disruption), we will notify you by email as early as possible.
§ 7 Allergens and Food Information
In accordance with the EU Food Information Regulation (FIC, EU 1169/2011), all 14 major allergens are indicated on the menu. If you have intolerances or allergies, please speak to our staff before ordering. Cross-contamination in our kitchen cannot be completely ruled out.
§ 8 Limitation of Liability
We are liable only for damages caused by gross negligence or intent. Liability for slight negligence is excluded to the extent permitted by law.
§ 9 Data Protection
The processing of personal data is carried out in accordance with our Privacy Policy and the General Data Protection Regulation (GDPR).
§ 10 Applicable Law and Jurisdiction
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Vienna, Austria. For consumers, the statutory place of jurisdiction pursuant to §§ 83a, 83b JN applies.
§ 11 Online Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
